Factors to Consider Before Detoxifying Your ... - Flirting With Fitness

Do you want to cleanse or detoxify your body? If you are the one of the many Americans who has heard that you may be carrying up to 20 pounds of excess waste and toxins due to buildup, you may be ready to take action. Before you start with a cleanse, it is important to determine if you are the right candidate.

Factors that can help you determine if you are ready for a body detox or cleanse include:

Your health. Are you healthy? Do you suffer from any medical conditions, such as diabetes or a thyroid condition? If so, you should not start a body detox or cleanse without first speaking to your doctor. The are many cleansing programs available, including water fasting, juice fasting, the Master Cleanse, and making the switch to all-natural, organic foods. There should be at least one cleanse that is right for you, but others could lead to serious health problems.

In keeping with your health, if you are female, it is important to make sure you are not pregnant. When water fasting, your body will be robbed of needed nutrients. These nutrients are not only important for your body, but they are vital to unborn babies. Women who are pregnant or even breastfeeding should never try a water fast. Juice fasting and the Master Cleanse do provide you with some nutrients, but not enough. Speak to your doctor, but the only safe ways to detoxify your body while pregnant is with exercise and healthy eating.

Your daily and weekly schedule. If you opt for the Master Cleanse, you will see that 10-days is the recommended length of detoxification. Throughout those 10-days, you will experience a number of side effects, as well as make multiple trips to the bathroom. Although many are able to continue to work or go about their daily routine on the Master Cleanse, others find it difficult to do so. You may have to slightly modify your schedule or start a detox diet on the weekend.

Your weight. If you are overweight, a detox is recommended. As previously stated, our bodies can store up to 20 pounds of toxins and waste. Those who are at normal weight have some buildup, but it is significantly less. If you have tried different exercise plans, as well as healthy eating and still were met with defeat, it may be time for a cleanse. Although a detox is not recommended simply just for weight loss, the end results can improve your health in the long run.

Your ability to stay focused and on task. If you opt for waster fasting, juice fasting, or the Master Cleanse, solid foods will be eliminated from your diet. Whether you cleanse for 3 days or for 13, you will experience severe hunger pains. These pains will be accompanied with discomfort, nausea, vomiting, and headaches. Right away, you may wish to give-up. That is okay, but your ability to stay focused, on task, and avoid solid foods will result in success. If you do not believe you can go without food for 5 to 10 days, examine other options of detoxifying your body. Simple steps such as increasing water consumption, fiber consumption, and exercising can improve your health too.

In conclusion, unless you have health complications, no harm can come from at least trying a body detox or cleanse. With that said, always listen to your body. Any pain and discomfort you experience should pass within one to two days. If not, seek medical attention.

Small dinosaur 'hunted like cat'

Some predatory dinosaurs used guile and agility to outwit their feathered prey according to research.

The work, by a Canadian-Chinese team, is published in PLoS One.

Researchers studied the fossil remains of two Sinocalliopteryx dinosaurs and found they had been feasting on primitive birds and flying dinosaurs.

The prey could have been scavenged, but they argue that the presence of several birds in the stomach of one fossil implied the prey was actively hunted.

The researchers suggested that to catch their prey, the dinosaurs used ambush hunting techniques similar to modern cats.

Determining how dinosaurs lived is difficult - much of what we know is conjecture; built from a smidgen of material evidence and prodigious amounts of informed opinion.

Fossils provide one of the few tangible links back to the Cretaceous and Jurassic eras - when dinosaurs ruled the Earth. They represent a petrified and rudimentary snapshot of prehistoric life.

Good quality fossils are littered with clues that help palaeontologists rebuild dinosaur life.

And fossils harbouring vestiges of a dinosaur's last meal tell us much about the diets and feeding habits of these prehistoric creatures.

As Prof Mike Benton of the University of Bristol points out: "Any fossil with stomach contents is valuable because it tells us definitively what the animal was eating on the day it died."

Dr Phil Bell of the Pipestone Creek Dinosaur Initiative in Canada was particularly interested in the feeding habits of a species of dinosaur called Sinocalliopteryx gigas.

The hunter and the hunted

Sinocalliopteryx is a member of the Compsognathidae family of dinosaurs.

Compsognathids were ground-dwelling dinosaurs that walked on powerful hind legs.

Previous fossil finds suggested they were swift hunters feeding freely on lizards, dinosaurs, and mammals.

At 2.5m in length, Sinocalliopteryx was much larger than other members of the Compsognathidae family.

Two high quality Sinocalliopteryx fossils were recovered from the Yixian Formation in the Jehol Provence of north east China.

This formation - dating back to the Cretaceous period and rich in fossils - has yielded a number of significant dinosaur finds.

It was the stomach contents of the two well-preserved Sinocalliopteryx fossils that Dr Bell was particularly interested in.

Trapped within the first fossil were the remnants of a single Sinornithosaurus - a feathered flying dinosaur, measuring about 1m (3ft 4in).

This was tantalising evidence that these ground dwelling dinosaurs ate flying creatures.

Findings from the second fossil were even more revealing - inside were the preserved remains of two primitive crow-sized birds, called Confuciusorni.

Commenting on the significance of his find Dr Bell told BBC News: "It's so rare to get a glimpse into how dinosaurs - animals that have been extinct for millions of years - behaved. We now know more about the diet of this species than any other dinosaur."

Slowly, slowly catchy monkey

Two specimens, both containing flying prey, suggested that Sinocalliopteryx had a penchant for aerial quarry and also had the tools to catch them - but how?

Dr Bell's view is that the dinosaurs were wily hunters: "Cats are a perfect example; they are incredibly stealthy, stalking their prey before pouncing.

"I can imagine a Sinocalliopteryx stalking a bird through the underbrush waiting for the right moment to leap into the air and catching a bird mid-flight.

"They were elegant animals with long muscular legs and sharp "chompers" - perfect killing machines."

Prof Jingmai O'Connor from the Chinese Academy of Sciences, agrees: "Yes, the presence of more than one Confuciusornis suggests Sinocalliopteryx was a stealthy and adept predator."

A view shared by Prof Benton, who thought they might hunt by "creeping up on these agile birds, perhaps when they were feeding on the ground".

However, this conclusion has not gained universal approval.

Prof Zhonghe Zhou, also from the Chinese Academy of Sciences, said: "I am not quite convinced by the conclusion that Sinocalliopteryx was necessarily an adept stealthy hunter.

"It was undoubtedly an adept hunter, and could have been stealthy, but there is not yet enough evidence to support this."

Dr Jakob Vinther, of the University of Bristol, agrees: "The fact they were having a diverse diet of both small and large dinosaurs and primitive birds could suggest that they were not specialist predators but more likely a scavenger - a sort of vulture".

Although, "The finding of two bird specimens in the same Sinocalliopteryx does bring the potential that it was actively hunting them.

"The only way to strongly argue for this hypothesis would be to have more evidence", he added.

CHICAGO (AP) - The U.S. women's soccer team is going to savor its gold medal from the London Olympics a little longer.

The Americans said Thursday they will play two exhibitions against Germany in October as part of their post-Olympic "victory tour." The first game will be Oct. 20 in Bridgeview, Ill., with the second game three days later in East Hartford, Conn. The U.S. is 17-4-4 against the two-time World Cup champions, winning their last three meetings.

The Americans begin their tour Saturday against Costa Rica in Rochester, N.Y., Abby Wambach's hometown. They then host Australia on Sept. 16 in Carson, Calif., and Sept. 19 in Commerce City, Colo.

The U.S. women won their third straight Olympic title in London, beating Japan 2-1 in a rematch of last year's World Cup final.

Fit: Charman Driver joins the circus

by Charman Driver

I like to get high. I expect my clients to do it and I?d like to suggest you do it, too. Of course I?m talking about that natural high one gets through exercise. It releases endorphins ? substances in the brain that produce a natural boost in your mood. Exercising makes you feel good. You?ll also eat better, sleep better and look great because of it.

When I was asked to write a health and fitness column for Walter, I jumped (high) at the chance. I?ve spent over a decade preaching the gospel of physical fitness as a Pilates teacher, boot camp instructor and, more recently, as a Duke-certified integrative health and wellness coach. I know first-hand what physical fitness can do for you ? mind, body and spirit.

The truth is, not everyone gets as excited about this fitness stuff as some of us do and there is no one-size-fits-all form. I could wax on and on about the depressing number of sedentary folk in our country, state and city, but I?m not going there because I went on a run this morning. Can you guess my mood? Plus, my job is to be a part of the solution.

What motivates one person to dismount the couch and turn off the TV or get out of bed early to exercise is different from what works for another. If you could just find something ? anything ? to get inspired to exercise, what would that thing look like? Or maybe you simply want to inject life into your old workout regimen and try something new.

So how will you get your high? That?s where I come in.

Think of me as your guru of movement. (I almost wrote guinea pig, but thought better of myself). I will discover and experience ?adventures? in health and fitness in our great City of Oaks and tell you about them. I aim to think outside the gym and use my expertise to shed light on a variety of possible active life endeavors. I hope that you come away informed, inspired and motivated to create a healthy lifestyle through exercise.

Ditch the gym, join the circus

In my boundless pursuit of the high life, how appropriate that my first adventure for Walter would be to join the circus! That?s right, I said circus. Cirque de Vol, ?a creative movement arts studio,? has come to the Warehouse District in downtown Raleigh. Their website reads, ?Ditch the gym, join the circus.?

I?m in! I flipped for Cirque?s out-of- the-ordinary variety of creative movement programs including trapeze, aerial silks, acrobatic yoga, hoop dance, stilt-walking, juggling, fire dance and laughter yoga ? no joke!

In the end, I chose aerial silks for the sheer beauty and athleticism that I associate with Cirque du Soleil. I?ve seen those amazing acrobatic performers suspend, swing, spiral, fall and fly through the air on long, and colorful fabrics (silks) that hang securely from a high ceiling. Cirque de Vol claims that anyone can do this, and that no experience is required.

A wide smile stretched across my face as I walked into the sunlit studio and watched as my instructor ? the lovely Liz ?Bliss? Roberts ? unfurled the gorgeous red fabrics that tumbled to the floor.? Liz started talking about wrist locking, foot locking, tying, wrapping and gripping and then it was if I was hearing a foreign language ? a frown across the brow quickly replaced my smile.

She then explained how participating in aerial silks helps to build strength, flexibility, coordination and balance in the body (you?re speaking my language now, sister) and continued on in my native tongue as to how this form allows people to ?get? into their bodies by exploring movements in the air, defying gravity. (The smile is back).

We began on the floor with a short yoga-like warmup and moved on to the conditioning portion of instruction. Liz is a skilled and patient teacher and (gradually) the language became clearer as I learned challenging poses that allowed me to wrap, climb, flip, invert and drop in these gorgeous silk ribbons. Wow!

A cool-down signaled the end of my hour-and-a-half long session. I never once thought about the time what with all the laughing and fun we were having. But make no mistake, I worked deeply from my core, enlisted all major muscle groups (and some minor ones I didn?t know existed), increased my heart rate, perspired a great deal, and even flexed my brain muscles.

On my way out the door, Liz (now I get the ?Bliss? moniker) shouted after me, ?It?s addictive, isn?t it??? I hollered back: ?It sure is!?

?

Knowing How To Tap Into Your Web Design ... - Internet Business Blog

Designing a website isn?t always an easy task. How can you make a website that catches someone?s eye the first time they visit it? Do you know enough about coding? Read this article to learn how to feature your content properly thanks to a great design.

Realize that every step of web design will take a lot longer than you anticipated. Working toward an unrealistic deadline will cause poor work, and that will create larger issues down the line. The best thing to do is be real, and give yourself a proper amount of time to complete your work the correct way.

Invest in some books on the topic of web design. When purchasing instructional books, make an effort to pick those that start from your level of expertise.

Photoshop can be a great resource for web design. Check out dreamweaver for a program that can help you with your web design endeavors.

Do regular checks to make sure none of the links on your webpage are out of date or broken. Proper web designing entails having working links, so users do not get annoyed. Check your site daily for any problems, and make important updates as often as necessary.

Make sure you have checked for links that could possibly be broken. The best time to do this is just before you FTP the page over to the server. Visitors who encounter broken links and errors will not stay on your site long enough to view your product. Check your website regularly to make sure it works properly.

Ask your web host what is and isn?t allowed when it comes to streaming video through your site. Many hosts forbid hosting video using their servers. The FLV files take up too much space on public servers, so you need to check beforehand or else you might waste your efforts.

If you are looking to create your own site, then consider trying a grid or shared hosting, rather than using a dedicated host or VPS. In the beginning you will not know the amount of traffic that will visit your site, so it is best to not pay more than you really need to at first.

Allow your users the ability to cancel something if they are not happy with what they typed in. Actions may involve searching the website for archives or a variety of topics, signing up for newsletters and notifications, or simply filling out forms. Visitors do not appreciate not being able to cancel things that they are not interested in completing, and they may not wish to return to your site for future purchases.

If you are determined to purchase a particular domain name, but discover that it is already in use, you should visit some auction sites that sell used domain names, for example Sedo. These sites are clearinghouses for outstanding domain names that are now unused or have been sold which you can now pick up for comparatively little money.

Leaving white space for your users is a well-reviewed element of design. It makes your site easier to read, and your content easier to remember.

You should always ask to see a website design company?s portfolio before you hire their services. Find out which companies they have worked for and how good they are. Their portfolio should demonstrate examples that are very close to what you want and expect for your own site.

A good place to find a domain name that suits the kind of site you want to create is to look through domain auctions. SEDO and similar domain auctions can be a big help to your website by letting you purchase already-established domain names. Although it could be costly, it is worth having a great domain name.

The information imparted in the preceding paragraphs are a good starting point, so keep them in mind as you initiate your project. As you continue to learn more about site design, it will become easier to retain a competitive edge

Website designers must always aim for perfection. Even if creating a perfect website is not possible, setting your mind on it will help you stay motivated and improve your work constantly. Having this sort of motivation will be of great benefit regardless of the purpose of any site you build.

BOULDER, Colo., Aug. 29, 2012 /PRNewswire/ -- FreeWave Technologies, (http://www.freewave.com), manufacturer of the most reliable, high-performance spread spectrum and licensed radios for critical data transmission, today announced that it has deployed wireless radios for La Crosse, Wisconsin-based Dairyland Power Cooperative (http://www.dairynet.com/), one of the area's largest wholesale electric suppliers. Dairyland uses FreeWave's FGR-115 serial radios for a variety of distribution automation applications. It also uses FreeWave's HTPlus radios for certain applications requiring more effective throughput. The cooperative serves more than 600,000 customers in a service area of 45,000 square miles. Dairyland provides wholesale electricity to 25 member distribution cooperatives and 16 municipal utilities in four states (Wisconsin, Minnesota, Iowa and Illinois).

"FreeWave has been a trusted partner for several years and we continue to depend on its wireless data radio solutions for critical data transmission," said Ken Graves, manager of telecommunications services at Dairyland Power. "Most of our customers live in rural communities. Prior to using FreeWave radios, we researched a variety of potential vendors. It was essential to find a communication solution that was proven to transmit reliable data on a real-time basis, despite remote locations, a hilly landscape and steep terrain. Not only did FreeWave radios prove to have effective throughput, link performance and noise immunity, but they were easily integrated into our existing network. We are pleased with the radios we have deployed and are considering FreeWave for future wireless data radio needs."

When Dairyland first implemented FreeWave radios it deployed a small installation base of FGR-115 radios. Based on the performance of the initial deployment, a decision was then made to expand the FreeWave radio network. After a distribution automation study comparing various types of communication technology that faced harsh weather conditions and line-of-sight challenges from hilly terrain, the robust and reliable data transmission provided by FreeWave helped Dairyland Power make its decision to continue using the FGR-115 exclusively in its distribution network. FreeWave solutions are currently being used for a variety of distribution automation applications including AMI backhaul, transmission capacitor bank control, transmission line sectionalizing, and fault detection and isolation.

The FGR-115 is an early version of FreeWave's current product, the FGR2-CE. FreeWave's products are 100 percent backwards compatible, making customers' investments secure. The FGR-115 offers real-time remote diagnostics and setup, transparent to network communications and versatility - a single radio can operate simultaneously as a master, a slave and as a repeater. The quality and versatility of the FGR-115 has led to its use in locations ranging from Mount Everest and Antarctica to the Amazon rainforest. According to Graves, Dairyland has been especially pleased with the FGR-115's link performance, single system integration and overall reliability. The FreeWave HTPlus Ethernet radio is ideal for customers who need an industrial grade high-speed Ethernet radios that operate in harsh environments and noisy RF conditions. It delivers data at a rate of up to 867 Kbps and is an ideal radio for SCADA backhaul networks.

"We are pleased to provide wireless data radio solutions to Dairyland Power Cooperative," said Curt Goldman, market manager of utilities at FreeWave Technologies. "FreeWave strives to provide the most trusted solution for distribution automation applications, and our entire team, from the engineers to the factory to customer support, works hard to ensure we are meeting all of our customer's needs. We look forward to a continued partnership with Dairyland Power."

Ukraine rejects appeal by jailed ex-PM Tymoshenko

KIEV (Reuters) - A Ukrainian high court on Wednesday rejected an appeal by former prime minister Yulia Tymoshenko against her conviction for abuse of office for which she is serving a seven-year prison sentence.

"The judges of the court have reached the conclusion that the appeal cannot be satisfied," judge Olexander Yelfimov told the court.

The European Union and the United States say Tymoshenko's prosecution was politically motivated by President Viktor Yanukovich's leadership and have called for her to be released.

The 51-year-old opposition leader was not present in court because of persistent back trouble which has kept her confined to a state-run hospital in eastern Ukraine.

She was jailed last October in connection with a gas deal which she brokered with Russia in 2009 and which the Kiev government says saddled Ukraine with an exorbitant price for gas imports that weighs heavily on the economy.

In a separate trial, which has been adjourned several times because of her ill health, Tymoshenko is accused of embezzlement and tax evasion going back to alleged offences when she was in business in the 1990s.

Roof repair Denver service is therefore a growing business owing to the numerous real estate projects coming up every year. The city?s skyscrapers provide office space to corporate and business operating in the city. However, individuals working in Denver city usually look for residences away from the city but close enough for convenience. This has led to an increase in house demand specifically in estates around the city.

Google on Apple v. Samsung: most infringed patents 'don't relate to the core Android operating system'

When the jury in Apple v. Samsung handed down its verdict on Friday, we watched Apple take a victory lap and heard Samsung warn of hampered competition, but one company remained conspicuously silent: Google. This weekend, though, Mountain View finally released a statement, insisting that while Samsung lost the trial, the ruling doesn't actually implicate Android. "The court of appeals will review both infringement and the validity of the patent claims. Most of these don't relate to the core Android operating system," the company said, noting that several of these patents are being revisited by the US Patent Office. Still, buried in that statement is an implicit acknowledgment that if Samsung can't reverse the decision on appeal, innovation among Android devices might well be be stifled:

"The mobile industry is moving fast and all players - including newcomers - are building upon ideas that have been around for decades. We work with our partners to give consumers innovative and affordable products, and we don't want anything to limit that."

Of course, Samsung has indeed said it intends to appeal (and an internal memo reported by CNET corroborates this), so it would seem that the proxy battle against Android is far from over, and the drone of legalese is sure to continue.

Darwin discovered to be right: Eastern Pacific barrier is virtually impassable by coral species

ScienceDaily (Aug. 27, 2012) ? A coral species that is found in abundance from Indonesia eastward to Fiji, Samoa, and the Line Islands rarely crosses the Eastern Pacific Barrier toward the coast of the Americas, according to a team of researchers led by Iliana Baums, an assistant professor of biology at Penn State University. Darwin hypothesized in 1880 that most species could not disperse across the marine barrier, and Baums's study is the first comprehensive test of that hypothesis using coral. The results of the scientific paper, which will be published in the journal Molecular Ecology, has important implications for climate-change research, species-preservation efforts, and the economic stability of the eastern Pacific region, including the Galapagos, Costa Rica, Panama, and Ecuador.

The Eastern Pacific Barrier (EPB) -- an uninterrupted 4,000-mile stretch of water with depths of up to 7 miles -- separates the central from the eastern Pacific Ocean. In his writings, Darwin had termed this barrier "impassable" and, since Darwin's time, scientists have confirmed that many species of marine animals cannot cross this oceanic divide. However, until now, researchers had not performed a comprehensive analysis of the impact of the barrier on coral species. "The adult colonies reproduce by making small coral larvae that stay in the water column for some time, where currents can take them to far-away places," Baums said. "But the EPB is a formidable barrier because the time it would take to cross it probably exceeds the life span of a larva."

To test whether or not coral larvae are able to travel across the barrier, Baums and her team chose a particularly hearty species called Porites lobata. "Compared with other coral species, Porites lobata larvae seem able to survive for longer periods of time; for example, the weeks that are required to travel across the marine barrier," Baums said. "This species also harbors symbionts in its larvae that can provide food during the long journey. In addition, the adults seem able to brave more extreme temperatures, as well as more acidic conditions. So, if any coral species is going to make it across, it is this one."

Baums and her team hypothesized that coral larvae originating in the central Pacific might be pushed along the North Equatorial Counter Current, which flows from west to east and becomes stronger and warmer in years with an El Ni?o Southern Oscillation event -- a climate pattern that occurs about every five years. "Coral larvae are not very mobile," Baums said. "So the only way coral larvae originating to the west of the barrier could travel to the east is along an ocean current, and warming of a current like the North Equatorial Counter Current would help larvae survive. If coral have traveled along this current in the past, we should find populations that are genetically similar living from the Galapagos to Costa Rica, Panama, and Ecuador."

The team members collected coral samples of the Porites lobata species from both sides of the Eastern Pacific Barrier and performed genetic tests using special markers called microsatellites -- repeating sequences of DNA that are informative for the purpose of distinguishing among individuals. "We found that Darwin was right: the EPB is a very effective barrier," Baums said. "For the most part, samples we found to the east are genetically dissimilar to those we found to the west. This means that coral larvae originating in the central Pacific simply are not making it across the ocean to the Americas."

The only exception, the team found, was a relatively small population of Porites lobata living near Clipperton Island, which is located just north and west of the Galapagos. The samples collected there were genetically similar to samples found throughout the central Pacific, indicating that the species had migrated there from the west relatively recently. "Interestingly, the coral that are lucky enough to cross the EPB to Clipperton Island stay there and don't go any farther," Baums explained. "In other words, we find that Porites lobata are not migrating south and east to the Galapagos after making it to Clipperton. We believe this is because these coral are adapted to the warmer conditions that their parents enjoyed to the west of the EPB; for example, near the Line Islands, Fiji, and Samoa. "Coral reefs thrive in shallow water in areas where the annual mean temperature is about 64 degrees Fahrenheit," Baums said. "The eastern Pacific tends to be much cooler; in part, because of a process called upwelling -- a phenomenon that occurs when winds stir up cold, deep ocean water, pulling it to the surface. Clipperton Island may provide a similar-enough environment to the Central Pacific, but the Galapagos area simply may be too cool."

The team's findings about the ability of coral to travel across the marine barrier have important implications for the economic stability of the eastern Pacific, the region's species-conservation efforts and, more broadly, for the impact of climate change on tropical ecosystems. The Galapagos, Costa Rica, Panama, and Ecuador all rely heavily on tourism. Tourism, in turn, relies on healthy reefs that divers can visit and the sale of shellfish and lobster -- species that are maintained, in large part, by the presence of coral communities.

"The take-home message is that coral populations in the eastern Pacific need to be protected," Baums said. "That is, in the event of any large-scale coral crisis, we cannot count on coral populations in the eastern Pacific being replenished by larvae from the west." Baums explained that, especially as Earth's surface continues to warm, such a crisis to coral reefs is not unlikely. During the El Ni?o Southern Oscillation events that occurred from 1982 to 1983 and from 1997 to 1998, some of the reefs experienced a 90-percent loss. Although they ultimately were able to bounce back, a stronger El Ni?o event might spell extinction for some coral species.

In addition to Baums, other researchers who contributed to the study include Jennifer Boulay and Nicholas R. Polato at Penn State and Michael E. Hellberg at the Louisiana State University.

The research was funded by the National Science Foundation.

Sony to Shut Down Optical Drive Business [REPORT]

Sony is planning to close its optical drive division Optiarc, Japan?s Asahi Shimbun reports.

Optiarc, which holds a 10-15 percent share of the optical drive market, incurred huge losses to Sony in 2011, and Sony will reportedly shut it down by March.

Sony Optiarc was founded in 2006 as a joint venture between Sony and NEC, with Sony buying NEC?s 45% share in 2008.

The move is a part of Sony?s global restructuring effort, in which the company plans to cut some 10,000 jobs. Just last week, Sony announced it would cut 1,000 jobs in an effort to revamp its mobile division.

Apple strikes licensing deal with Motorola in Germany, heralds more peaceful times?

Apple strikes licensing deal with Motorola in Germany

Motorola's war with Apple has certainly been overshadowed by the showdown with Samsung. But, with the latter melodrama shifting into quiet mode, focus is coming back to the battle with Moto. That ongoing story has taken a rather unexpected turn, however. A filing on Monday revealed that the Google subsidiary has agreed to license some (if not all) of its standards-essential patents to Cupertino... in Germany, at least. When exactly the deal was struck isn't clear, and neither side has announced a royalty rate as of yet. It could be that the German courts will decide what is appropriate according to FRAND rules, but the agreement also includes an admission by Apple that it is liable for past damages relating to these patents. The terms seem to include only "cellular standard-essential" patents, which means the company's claims regarding WiFi and video codecs could still be used as an avenue of attack. But, with at least one set of FRAND patents set aside, we wouldn't be surprised if the rest followed. It may be that Moto has simply decided to pick its fights more carefully, in light Apple's recent legal victory and growing pressure from the European Commission surrounding potential abuse of standards-essential patents. Or, it could be an olive branch and a sign that the patent wars are winding down -- a possibility we'd joyously embrace.
